The Paradox of Compliance: ITAR and Anti-Discrimination Concerns
Recent settlement agreements between the U.S. Department of Justice (DOJ) and private companies have shown that DOJ will not tolerate employers discriminating against foreign persons – even where export controls might appear a concern. At the same time, the export agencies have specific requirements that mandate certain export-controlled information to be restricted from foreign person employees and thus pushing companies to evaluate whether certain positions should be limited to U.S. persons only. The intersection of export control laws and U.S. immigration and anti-discrimination laws is nuanced and complex. With enforcement on the rise, this webinar will provide guidance on how to best navigate these areas of the law.
