Recent settlement agreements between the U.S. Department of Justice (DOJ) and private companies have shown that DOJ will not tolerate employers discriminating against foreign persons – even where export controls might appear a concern. At the same time, the export agencies have specific requirements that mandate certain export-controlled information to be restricted from foreign person employees and thus pushing companies to evaluate whether certain positions should be limited to U.S. persons only. The intersection of export control laws and U.S. immigration and anti-discrimination laws is nuanced and complex. With enforcement on the rise, this webinar will provide guidance on how to best navigate these areas of the law.

This webinar will cover:

  • Overview of the relevant laws and regulations impacting the hiring of foreign persons in the United States
  • Challenges & best practices
  • Recent cases
  • Common scenarios

Who should attend this webinar:

  • Compliance professionals
  • General counsels and in-house lawyers
  • HR professionals
  • Immigration lawyers

This webinar will provide PowerPoint slides and include commentary from Olga Torres, who counsels clients on compliance with the International Traffic in Arms Regulations (ITAR), the U.S. Export Administration Regulations (EAR), and the various embargo and sanctions programs administered by the Office of Foreign Assets Control (OFAC). She regularly represents clients before the U.S. Department of State Directorate of Defense Trade Controls (DDTC), U.S. Department of Commerce Bureau of Industry and Security (BIS), and the U.S. Department of the Treasury.

“This was a very concise presentation – well put together for a complicated subject. The use of specific examples was definitely helpful to a broader audience (those that don’t have the trade compliance regulatory background). Definitely recommend that companies have their HR personnel attend.”
Janet Pierce, Meggitt / Attendee of this webinar

“I thought this session was very informative! Olga was quite knowledgeable, and was able to answer all questions that came her way. I also liked the used of real life examples, they really helped drive the points home!”
